A first information report means the information, by whomsoever given, to the officer in chrge of police station in relation to comission of a cognizable offence and which is first in point of time and on the strength of which the investigation into that offence is commenced. A statement recorded after the commencement of investigation is not a F.I.R.

According to sec 154:-

Information in wriring, or

Reduce to writing (given orally)

Information as taken down in writing shall be read to informant

Substance of information entered by the police officer in the book called station diary

A coppy of information as recorded above shall be given free of cost to the informant

If the officer incharge refuses to record the information, any person aggrieved by such refusl may send in writing and by post the substance of such information to the supriintendent of police concerned.

                                            A  telephonic  message- whether a F.I.R

Normally, a telephonic message received by a police officer regarding the commission of cognizable offence is not a F.I.R (under sec. 154), Since it is neither reduce to writting by the police, nor given in writing Signed by the police, nor given in writingsigned by the informant.  In such case, the view of the court is that the report can be recourded by the station writer who recived the messages.

The staton writer died after reciving and recording the message and thus could not be produced in the court for th purpose of autheticating the information as recorded. No reliance on it was placed by the court.
 
A First Information Report (FIR) should be lodged at the nearest police station as soon as an offence has been committed. The sooner it is lodged, the faster the investigations can be started

WHO CAN FILE AN F.I.R.

Any person can file an F.I.R. He need not be the aggrieved person. It may be merely hearsay and need not be by the person who has had firsthand knowledge of the facts.

WHERE TO FILE AN F.I.R.

An F.I.R. can be filed in the police station of the concerned area in whose jurisdiction the offence has occurred. It must be made to the officer-in-charge of the police station and if he is not available the Assistant Sub Inspector is competent to enter upon the investigation
