How to Garnish Wages on a Judgment in Alabama
- 1). Obtain the name and address of the judgment debtor's employer.
- 2). Download a Process of Garnishment form from the Alabama Administrative Office of Courts website (see "Resources"). Alternatively, obtain a form from the clerk in the court that entered your judgment.
- 3). Complete the form. Choose whether you want to garnish 20 or 25 percent of the judgment debtor's wages each month. Under federal law, you may not garnish more than 25 percent of the debtor's disposable income, subject to certain reductions provided for in law. Have the form notarized.
- 4). File the Process of Garnishment with the clerk in the court that entered your judgment. The clerk of the court will direct an officer of the court --- usually the sheriff --- to serve copies of the document on the employer and the judgment debtor. The employer will also receive a Garnishee's Answer form. The employer is given 30 days to complete and return the answer form to the clerk, along with the first month's garnishment. Thereafter, the employer must submit further garnishments to the clerk, on a monthly basis, until the full debt has been satisfied.
