    Function

    • To prevent unauthorized employment, the Act would have amended the Immigration and Nationality Act to require employees to verify the legal status of their employers. This would have been accomplished through the Electronic Employment Verification System or the Secure Employment Eligibility Verification System, both of which would have been established by this Act.

    Implementation

    • The Act would have been implemented by the Commissioner of Social Security. In addition to establishing the electronic systems to verify the legality of employees, the Act would have also required the Commissioner to establish a Employment Verification Advisory Council to assist in implementing the Act.

    History

    • The Act was originally proposed by Representative Samuel Johnson of Texas on Feb. 28, 2008. It never left the House Subcommittee on Ways and Means, and thus, as of August 2010, the Act is not law.
